§1 Scope of Application

These Terms and Conditions apply to all current and future business relationships. They apply only to end customers and only in the version valid at the time of the order. Éditions Guy Binsfeld does not recognize any differing terms and conditions unless their validity has been expressly agreed to in writing.

§2 Conclusion of Contract

By placing an order, the customer declares a binding intent to purchase the goods and accepts the delivery conditions of Éditions Guy Binsfeld. The purchase contract is concluded when Éditions Guy Binsfeld accepts the contractual offer contained in the order. Immediately after receiving your order, you will receive an email confirming receipt of the order and listing its details (order confirmation). This order confirmation does not constitute acceptance of your offer but merely informs you that your order has been received. A purchase contract is only concluded when the publisher ships the ordered product to you and confirms the shipment with a second email (shipping confirmation). No purchase contract is concluded for products from the same order that are not listed in the shipping confirmation. Please note that Éditions Guy Binsfeld sells all products only in quantities typical for households. This applies both to the number of products ordered within a single order and to the placement of multiple orders for the same product where the individual orders each comprise household quantities.

§3 Reservation of Unavailability

The publisher reserves the right not to execute an order if the ordered title is out of stock. In this case, you will be informed immediately of the unavailability. Any purchase price already paid will be refunded without delay.

§4 Prices

The stated prices are final prices in euros. They include the statutory value-added tax. The indication of prices does not constitute an offer but serves only as non-binding information for the customer to the best of our knowledge. The only binding price is the sales price at the time of delivery.

§5 Shipping Methods

The delivery of books is carried out by Éditions Guy Binsfeld. The delivery and payment conditions stated here apply.

§6 Shipping Costs

Books can also be purchased online and collected in person at Éditions Guy Binsfeld (14, Place du Parc, L-2313 Luxembourg) free of shipping charges.

§7 Terms of Payment

The purchaser may pay the purchase price by credit card.

§8 Delivery Times

The delivery time for a title is usually between 3 and 7 working days. If a book is not immediately available, you will receive a notification from us within three working days stating the reason for the delay and the approximate delivery time known to us.

§9 Right of Withdrawal

Within 14 days of receiving the goods, you may withdraw from your contractual declaration without giving any reason by sending an email to editions@binsfeld.lu and indicating your customer number as stated on the invoice. To meet the withdrawal deadline, it is sufficient to send the withdrawal or the goods in time. Upon receipt of the withdrawal, Éditions Guy Binsfeld undertakes to refund any payments made. You, in turn, are obliged to return or hand back the received goods, stating your customer number. The return shipment must be prepaid. Please choose the most cost-effective shipping method, e.g. book shipment. Unpaid returns will not be accepted by Éditions Guy Binsfeld. If the order value is less than €40, you bear the cost of return shipping. For higher order values, as well as for returns of unordered or defective goods, Éditions Guy Binsfeld will in any case reimburse the cost of return shipping. If the goods have already been used and show signs of wear, the purchase can no longer be revoked.

§10 Complaints

Complaints and claims can be submitted to the address provided under “Contact”. Books that are defective can be exchanged for flawless copies within the statutory period. If a book is no longer available, the purchase price will be refunded. Further claims are excluded.

§11 Place of Performance and Jurisdiction

The place of performance and jurisdiction, unless otherwise stipulated by law, is Luxembourg. Shipping is at the recipient’s risk.

§12 Data Protection

Data protection is important to us. Please refer to our Privacy Policy.

§13 Applicable Law

Luxembourg law applies.

§14 Miscellaneous

If individual provisions are or become invalid, the validity of the remaining provisions shall not be affected.
